If you have an opinion, you can state that opinion. If someone is wrong, you can say they're wrong. If someone's a dick, you can call him a dick. It's not the right's fault that people are dicks, and as with any right, it is moot once you start using it to legitimately hurt people, but it's still better than a world where the definition of hate speech can be so flimsy and so high of an offense that it can ruin any innocent person's life. Not saying it's perfect, but a concrete line has to be drawn somewhere that's not "I don't like what this person said."
