The game can be developed in UDK for free as long as there is no commercial gain. Are you VERY familiar with the UDK licencing terms and see a fault in my thinking? Then please tell me! I see "The UDK is also FREE for non-commercial use. Feel free to use the UDK to make any application (game or otherwise) for free distribution. No additional license (beyond the EULA) is required. Just go for it." in the commercial terms, so I think I am fine.
What is your opinion on using the unreal engine? Go ahead and say it! (Just be polite) It can be a quick conversion from Unity to Unreal so don't fear that.
In my personal, horribly uneducated opinion, I think the Unreal engine is better if you want better graphics. I'm not so sure about compatibility or features, though.
Better graphics, better items, better interface, better doors, better modeling, better map construction, better physics, easier to build, and a bunch of other stuff. The only problem I see will be the size of the download.
