Either If It is Open Source [ Allows you to modify, distribute etc. ], Royalty Free [ Used as long as credit is usually given ] or made by yourself.

If a Game releases a Soundtrack that you pay for, Then those Songs are under Copyright and not able to be used.

Now that you mention it, It sort of does.

To be ambience it would probably have to fade out sooner and be quieter.
